Use of CookiesThe User acknowledges that DrumDevil uses cookies to maintain user sessions. DrumDevil does not sell or distribute cookie data with third parties.
MIDI and Bluetooth Device CommunicationDrumDevil requires the use of MIDI or Bluetooth MIDI protocol to communicate with electronic instruments. DrumDevil uses these protocol only to transmit input/output musical signals and to read general properties of the device such as the name of the drum kit.
Community Generated ContentThe User shall not publicize any content that could be considered illegal, vulgar, obscene, indecent, profane, or otherwise offensive. If you encounter user-generated content that breaks this policy please inform DrumDevil.
The data used to store and share user-generated patterns is owned by DrumDevil, not the User. DrumDevil may, at its discretion, alter, remove, or share content generated by the User. User-generated content may be intermittently pruned of practice patterns that are not commonly used. Incoherent or nonsensical practice patterns that serve no legitimate practice benefit may be removed from public access so that users do not have to filter through them. Users that repeatedly publicize such patterns may have their sharing privileges suspended or revoked. The User abandons all copyright claims, if any, to compositions the User has created with the DrumDevil software. DrumDevil also does not claim copyright ownership of any compositions generated by the DrumDevil software, including patterns generated by DrumDevil itself.
The User shall not generate content that infringes upon a copyrighted drum composition. When found to be in violation of this policy the User will be notified through the contact information provided when registering their account, infringing user-generated content will be removed from general access, and multiple offenses will result in loss of sharing privileges and/or account termination. Note that brief rhythmic compositions (not recordings), which DrumDevil is specifically designed to accommodate, are generally not considered copyrightable on their own merit. A user-generated practice pattern in the likeness of an unoriginal snippet and for the purpose of engaging in rote practice would likely be considered Fair and/or Transformative Use. Artists or publishers that believe user-generated content infringes upon their copyrighted work in a manner that would not fall under Fair or Transformative Use should notify DrumDevil according to the DMCA 512 Save Harbor process. DrumDevil is committed to following the DMCA process to protect the rights of artists while also providing its users the ability to create and share practice patterns for general use.
Disclaimer: Various architectural decisions were made when designing DrumDevil to naturally mitigate opportunities for users to engage in copyright infringement. First and foremost, DrumDevil is simply a timing and coordination sandbox tool designed to engage in rote drum practice as needed for any particular user. It is neither a music distribution service nor a music transcription service, nor is it capable of behaving as these servies in any legitimate sense. The "size" of user-generated practice patterns is heavily restricted, allowing only brief intervals meant for rote practice. This limitation negates users from "cloning" the drum composition of an average-length song or even a substantial portion of one. DrumDevil does not support uploading media to automatically generate content. The only mechanism available for users to generate content is with the embedded DrumDevil editor, which requires users to manually create practice patterns one note at a time. DrumDevil also does not support many foundational characteristics of authentic drum composition such as dynamics, tempo fluctuation, or fairly basic techniques such as drumrolls, rimshots, and cymbal chokes.
Appropriate UseAttempts to undermine the stability or integrity of the service may, at DrumDevil's discretion, result in loss of access to the User’s account without refund.
PurchasesDrumDevil uses a third-party payment processing platform to manage transactions. Credit card information is not collected and is not stored by DrumDevil in any form. DrumDevil assumes no responsibility for the security of payments when making purchases.
All sales are final, including payment for extension of subscription.
User AccessDrumDevil is not guaranteed to be available at all times. Server maintenance, updates, outages, and other disruptions may temporarily prevent access. In the event data is lost or corrupted, DrumDevil provides no guarantee of data restoration.
Changes to User AgreementDrumDevil reserves the right to change the terms of this User Agreement.
